Rules used
- Holding period. Listed shares and equity funds are long-term if held for more than 12 months. Most other assets need more than 24 months.
- Listed shares and equity funds with STT paid. Short-term gains are taxed at 20% under section 111A. Long-term gains are taxed at 12.5% on the part above ₹1,25,000 a year, under section 112A.
- Other long-term assets. These are taxed at 12.5% without indexation under section 112.
- Land or buildings bought before 23 July 2024. A resident individual or HUF can pay the lower of two options: 12.5% without indexation, or 20% with indexation.
- Other short-term gains. These are added to your income and taxed at your slab rate.
Needs review
Gains on debt mutual funds bought on or after 1 April 2023 are treated as short-term under section 50AA and taxed at slab rate. This rule is not yet confirmed against a 2026 official source.
Limits
The ₹1,25,000 exemption is for the whole year across all your listed equity sales, not each sale. Surcharge, losses and reinvestment exemptions such as section 54 are not included.
